Judge Mandates Christmas Visit with Grandma

In Bharat, the Bombay High Court mandated a woman to transport her 14-year-old offspring from the capital to Mumbai so he could see his nonagenarian maternal grandparent during the Yuletide season.

This is according to a report by the Times of India.

Furthermore, the tribunal instituted a recurring visitation plan following the maternal grandparent’s submission of a writ of habeas corpus to the judiciary.

The maternal grandparent, Sangeeta Sadwani, endured the loss of her son some years back, subsequently resulting in a decline in the rapport between her and the offspring’s parent. The submission asserted that despite several entreaties, the maternal grandparent had been wholly denied the prospect of encountering or corresponding with her grandchild, eliciting intense sentimental suffering.

The plaintiff’s concerns were defended by the legal company M/s YNA Legal LLP, represented by advocates Anvi Mehta, Dr. Suruchi Deshpande Yusuf and Dr. Yusuf Iqbal Yusuf.

During proceedings, the offspring’s parent informed the tribunal that she presently resides in the capital alongside her offspring.

A judicial panel of Justices Bharati Dangre and Shyam Chandak declared: “Taking into consideration these factors, coupled with the actuality that December 25 constitutes the Yuletide holiday, we instruct the parent to convey the minor to Mumbai and deliver him to the plaintiff’s abode between 11:00 AM and 12:00 PM. The offspring is authorized to stay in the companionship of the maternal grandparent until 5:00 PM. Bearing in mind the parent’s departure from the capital, we anticipate one more visit from the offspring to the maternal grandparent before their return.”

The High Court additionally stipulated that the offspring must visit his maternal grandparent on either the second or fourth Sunday of each month unfailingly. The parent should either go with the offspring or arrange for her to attend. The parent was similarly instructed to furnish her address in the capital and contact details to the investigator.

The maternal grandparent also engaged the constabulary as a participant in the situation. In view of these directives, the tribunal concluded the evaluation of the petition, deeming that the plaintiff’s requests had been significantly met.
